1. Identification of the Parties

This Accommodation Contract is governed by Portuguese Law, specifically the legal regime for Local Accommodation (Alojamento Local) established by Decree-Law No. 128/2014, as amended. By proceeding with the booking, the Guest explicitly accepts these terms.

2. Crucial Disclosure: Location & Noise Tolerance

Please read carefully before booking. By confirming your reservation, you acknowledge and accept the following conditions regarding the property's location:

  • The apartment is located on a vibrant, central street in the historic center of Lagos.
  • Noise Level: During the peak season (May to October), this street features active bars and nightclubs operating until 2:00 AM.
  • Loud music, street noise, and crowd activity will be highly audible inside the apartment during these hours.
  • No Claims: By accepting this contract, the Guest agrees that they have been fully informed of the noise conditions. No refunds, discounts, or cancellations will be granted due to noise complaints related to the surrounding nightlife.

3. Property Description & Occupancy

  • The property is a T2 apartment containing two bedrooms, each equipped with one standard double bed.
  • Maximum Capacity: Strictly limited to the number of guests stated in the booking (Maximum 4 persons). Unregistered guests are strictly prohibited and will result in immediate termination of the contract without refund.
  • Pets: Strictly prohibited. Bringing a pet will result in immediate eviction and loss of the security deposit.

4. Security Deposit (Caução) & Damages

Pursuant to Portuguese Civil Law regarding short-term rentals, a Security Deposit is required prior to check-in. This deposit acts as a pre-authorization on your credit card.

  • The deposit is held to cover any potential damages to the property, missing inventory, or extreme cleaning required due to violation of house rules.
  • After check-out, the cleaning staff will conduct an inspection. If no defects or missing items are found, the pre-authorization will be released within 3-5 business days.
  • If damages exceed the deposit amount, the Operator reserves the right to pursue further legal action in Portuguese courts.

5. Apartment Inventory & Replacement Costs

The apartment is fully equipped. Any damaged or missing items will be deducted from the security deposit according to the replacement value table below:

* The Operator reserves the right to update this inventory table. Actual deduction will be based on the receipt of replacement/repair.

6. House Rules (Regulamento Interno)

Failure to comply with these rules may trigger police intervention (GNR/PSP) and immediate eviction without refund, as stipulated by Portuguese law:

  • Quiet Hours: Between 22:00 and 08:00, guests must minimize noise to respect neighbors (General Noise Regulation - Decree-Law No. 9/2007).
  • No Smoking: Smoking inside the apartment is strictly forbidden. A €200 deep-cleaning fee will be charged if evidence of smoking is found.
  • Trash Removal: Guests must dispose of their garbage in the public municipal bins outside before check-out.

7. Legal Compliance (AIMA / SEF)

Portuguese law mandates that all foreign guests must be registered with the immigration authorities (AIMA - formerly SEF) via the Boletim de Alojamento. The Guest agrees to complete the digital KYC identity verification process prior to check-in. Failure to provide valid ID documents constitutes a legal barrier to entry, resulting in cancellation without refund.
